16TH KEMRI ANNUAL SCIENTIFIC AND HEALTH CONFERENCE (KASH)

CONSENT FOR USE OF IMAGES, VIDEOS AND/OR AUDIO

(MEDIA RELEASE FORM)

Kenya Medical Research Institute (hereinafter “KEMRI”) is a State Corporate established under the State Corporations Act, Legal Notice No.35 of March 2021 as read together with the Fourth Schedule of the Science, Technology and Innovations Act 2013.

Purpose and Scope

KEMRI uses a wide range of information and materials to sensitize people about our services and activities. Amongst such materials, KEMRI could use still photographs, videos and/or audio of persons carrying out their activities or using our services within the Institute premises or out of the Institute premises during official functions of the Institute. This may include printed and electronic publications, video, audio, adverts, press releases, photo galleries, news media, social media, and any other media we might use to promote (publicity, communication, marketing, and advertising) KEMRI in the future.

Warrants and Liabilities

It is understood and agreed that participants will not receive any fee or future payment for their participation or for the use of the said material by KEMRI, now or in the future.

It is further understood that participants will not hold KEMRI or any related parties liable for any claims, demands, or legal actions arising from the use or exploitation of the said material, including but not limited to copyright claims.

The participants warrant that the media consent does not infringe or violate upon the rights of any third parties including but not limited to trademarks, copyrights, right to privacy or any other proprietary rights.

Participants agree to indemnify and hold KEMRI harmless from and against any and all claims, liabilities, damages, costs and or expenses arising from or related to any breach of the above representations.

 

Data Protection and Privacy

The parties are bound by the provisions of the Data Protection Act 2019 in the collection, procession and use of data under this Media Release Form.

No personal data shall be sold, transferred or otherwise made available to any third party without the express consent of the participants to whom the data pertains.

 

Subjects Rights

Participants assign all rights to the said material to the Kenya Medical Research Institute (KEMRI) for its unrestricted use.

In accordance with the provisions of the Data Protection Act 2019, all participants are conferred certain rights that can be exercised at any point. These include:

  1. to be informed of the use to which their personal data is to be put;
  2. to access their personal data in custody of data controller or data processor;
  3. to object to the processing of all or part of their personal data;
  4. to correction of false or misleading data; and
  5. to deletion of false or misleading data about them.

The participants, in addition to these rights, can at any time withdraw consent for the processing of their data at any time. This could include the processing of all or part of their data.

Authorization and Waiver

By attending the 16th KEMRI Annual Scientific and Health Conference (KASH), participants hereby grant consent to KEMRI, its agents, partners, and collaborators to interview, photograph, audio-record, and/or video-record them for purposes including, but not limited to, event coverage, publicity, documentation, and the dissemination of information across various media platforms.

 

Participants acknowledge that the material captured (hereinafter “the said material”) is obtained by the Conference Communications team and the media practitioners as part of their official duties.

Participants grant KEMRI and its affiliates, partners, and assignees the right to use the said material and any adaptations or reproductions thereof, in whole or in part, for purposes of education, communication, promotion, and advertising across digital media channels, including but not limited to Website, LinkedIn, Facebook, X (formerly Twitter), Instagram, YouTube and print and electronic media including television and newspapers.

The intellectual property (including copyright, trademark, and other related rights) of any data and/or information covered by this consent form shall be assigned to KEMRI and will become the property of KEMRI. Embarrassing or distressing images, or inappropriate content, will not be used.

Participants waive any right to approve the finished product or products or the advertising copy or printed matter that may be used in conjunction therewith or the use to which it may be applied. Participants also waive any right to any compensation or royalties in connection with the use of the image and name.

Entire Agreement

This agreement constitutes the sole and complete agreement between KEMRI and the participant(s) and shall be governed by the laws of the Republic of Kenya. Parties shall not rely on any other warranties, guaranties or representations whether oral or reduced to writing.
